Making moral or ‘ex gratia’ payments (via wills or other gifts)

Important information before starting this application

Please read our guidance before completing this application.

The guidance explains the points you must consider and when you do and don’t need to apply for Commission authority, for example if the payment falls within the set limits outlined.

If you do need to apply for authority, reading the guidance will help you make sure you have all the information you need to answer the questions and help us deal with your application more quickly.

Make sure you have everything ready before you start the application as it will timeout after 30 minutes of inactivity and you will lose any details already entered.

At the end of the application, you will need to upload documents to support your application. You will need:

  • Where the decision was made by the trustees – the minutes of the meeting where this was agreed or a trustee resolution. This must explain why the trustees could reasonably be regarded as being under a moral obligation to make the payment(s)
  • Where the decision is made by a person or people with delegated authority – a statement which confirms delegated authority and which sets out why the trustees could reasonably be regarded as being under a moral obligation to make the payment(s)
  • Any other documents that support or help explain the decision
  • Any legal advice received if possible
  • If the application relates to a gift in a will:
    • A copy of the signed will
    • A copy of the grant of probate
    • Any draft or unexecuted wills
    • Any evidence that the will does not account for the deceased’s intentions or that the deceased’s wishes could not be carried out
